Carpevigo AG: First action for damages dismissed

The financier of plants and power stations for solar power generation continues to hold its own in the various legal disputes pursued by a professional plaintiff.
Carpevigo AG has just achieved an extension of the maturity of the bond WKN A0N3X2 until 30.06.2026. Parallel to this, lawsuits are still ongoing concerning the bond extension in 2016 until 30.06.2021. From the camp of the sufficiently known professional plaintiffs, damages have been filed with the claim that the executive board of Carpevigo AG unlawfully initiated the execution of the resolutions of 22.06.2016. The first decision in this regard has now been issued by the Munich Regional Court II, which rejected a corresponding action for damages as inadmissible and unfounded in a judgement dated 3 September 2021. According to the court, a motion for payment against the company is inadmissible.
Furthermore, there was no breach of duty or any other reason for a claim for damages. The action was therefore dismissed with costs. It remains to be seen whether the other side will appeal.
The restructuring continues. The three joint representatives representing the various bonds are scheduled to meet on 17 September 2021.
