Announcement of the filing of actions for avoidance according to § 20 para. 3 SchVG against the resolutions of the creditors’ meeting within the scope of the voting without a meeting from 16.02.2021, 0:00 hours (CET), until 19.02.2021, 24:00 hours (CET) for the bearer bond, WKN: A1MA45, of Carpevigo Holding AG.

We hereby announce that a bondholder has brought the following action for avoidance against the passing of a resolution at the creditors’ meeting on the bond  WKN: A1MA45 in the course of the creditors’ meeting without voting from 16.02.2021, 0:00 hours (CET), until 19.02.2021, 24:00 hours (CET), on the resolution passed, i.e., instructions to the common representative:

– Action of Koch Münzhandel & Verwaltung SE, represented by the Managing Director Mr. Rolf Koch, Zur Eisernen Hand 25, 64367 Mühltal, to the Regional Court Munich II – Chamber for Commercial Matters -, file number: 2 HK O 1031/21.

NOTE: The action for avoidance is directed exclusively against the instruction given to the Joint Representative at the creditors’ meeting mentioned above. It is expressly not directed against the planning procedure carried out based on the StaRUG.
